Employment tribunal dismisses bid to overturn settlement agreement in King Gaming case
An employment tribunal has rejected an attempt to reopen a legal dispute involving a former employee of Champion Tech Limited, part of the King Gaming group. The decision marks the end of a bid to challenge a previously agreed £25,000 settlement and pursue a constructive dismissal claim.
Seng Hooi Yap, who worked for the eGaming company, sought to set aside the settlement agreement he had signed with the firm. He argued that Champion Tech Limited had misrepresented the circumstances surrounding his departure, which he believed would have allowed him to proceed with a constructive dismissal case at the tribunal.
However, tribunal chair Douglas Stewart found no evidence to support claims of misrepresentation. With no grounds to overturn the existing agreement, the application was dismissed, meaning the original £25,000 settlement remains binding and the case cannot proceed further.
This decision reinforces the importance of employment agreements on the Isle of Man. Once a settlement is formally agreed and signed, challenging it through the tribunal requires clear evidence of misconduct or misrepresentation by the employer—a high legal bar to meet.
